Weld County Building Code Board of Appeals
Article 1 – Name of Board
The Committee shall be called the Weld County Building Code Board of Appeals in conformance with the resolution creating the committee which was adopted by the Board of County Commissioners on September 25, 1974.
Article II – Functions of the Board
The functions and duties of the Weld County Building Code Board of Appeals are to determine the suitability of alternative methods of construction and alternate materials, and to provide reasonable interpretation of the provisions of the Weld County Building Code Ordinance.
Article III – Membership of Board
A. Membership – The Board shall consist of seven (7) members as set forth in the Resolution formulating the committee which was adopted by the Board of County Commissioners on September 25, 1974, and subsequently amended. The membership shall include:
1. An electrician certified by the State of Colorado.
2. A master plumber certified by the State of Colorado.
3. A person experienced in the construction and installation of heating, cooling, and ventilating systems.
4. A building contractor or other person experienced in the construction trade.
5. A professional engineer licensed in the State of Colorado.
6. A fire marshal or other person qualified in fire protection measures.
7. One person from any of the above trades or with similar experience.
B. Appointment of Members – The members of the Board shall be appointed by the Board of County Commissioners.
C. The terms of members of the Board shall be for three (3) years, except for the initial membership which shall be appointed on a staggered term basis with actual terms ranging from one (1) to three (3) years.
D. Alternate Members – Each member may designate an alternate member, who, upon acceptance of the alternate by the board of County Commissioners, may attend meetings in the member’s absence and have the full rights and responsibilities of membership. If an alternate member attends more than three consecutive regular meetings, the regular member may be subject to replacement on the Board.
E. Reappointment of Members – Members may be reappointed to the Board at the discretion of the Board of County Commissioners.
F. No member shall serve for more than two consecutive terms.
G. Member vacancy – in the event of a vacancy among the members of the Weld County Building Code Board of Appeals, the Weld County Board of County Commissioners shall select a qualified resident of Weld County to fill such vacancy.
H. Membership dismissal – The members of the Weld County Building Code Board of Appeals shall serve without compensation and a member may be removed by the Board of County Commissioners for non-performance of duty, misconduct, or demonstratable conflicts of interest.
Article IV – Officers
A. The Board shall elect from its own members a Chairman and Vice-Chairman. Term of office shall be for one year.
B. In the absence of the Chairman, the Vice-Chairman will act in that capacity.
C. In the absence of the Chairman and Vice-Chairman, a temporary Chairman will be selected by the Board.
D. A secretary will be appointed by the Board Chairman.
Article V – Nomination and Election of Officers
A. The nomination and election of annual officers shall be held during the first regular meeting of each calendar year. Each nomination shall be seconded to be placed on the ballot, and elections shall be by written ballot unless there is no contest for the office.
Article VI – Meetings
A. Meetings shall be held when there is business to conduct.
B. Written notice of all regular meetings will be mailed at least one week prior to the meeting date.
C. Special meetings may be called when deemed necessary by the Chairman or the Department of Planning Services, provided that at least twenty-four (24) hours notice is given to each member prior to any special meeting. Notice may be accomplished by telephone or leaving written notice at member’s residence.
D. A quorum shall consist of not less than four members of the Board. A quorum will be necessary at any meeting where the agenda includes:
1. Changes in bylaws.
2. Review of utility or service easements
3. Election of Officers
4. Special meetings.
E. Robert’s Rules of Order shall prevail to the extent they are not in conflict with specific provisions of these Bylaws.
Article VII – Duties of Chairman
A. It shall be the responsibility of the Chairman to call all regular meetings, preside at all meetings, appoint committees, when and as required, and carry out general chairman responsibilities.
Article VIII – Duties of Vice-Chairman
A. It shall be the responsibility of the Vice-Chairman to assume the duties of the Chairman in his absence. Also, he shall perform other duties assigned by the Chairman.
Article VIII – Duties of Secretary
A. It shall be the responsibility of the secretary to send members notices of all meetings and keep minutes of all such meetings.
Article X – Conduct of Investigations, Findings
A. The Weld County Building Code Board of Appeals after conducting its hearings and investigations, shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant who is appealing an order of the Building Official or his authorized agents and a copy of the Weld County Board of Commissioners.
Article XI – Amendment to Bylaws
A. These Bylaws may be amended at any meeting of the Board by vote of the majority of the entire membership of the Board provided seven (7) days notice has been given to each member of the Board.
