The role of the Human Rights Committee (HRC), as understood by the Division for Developmental Disabilities (DDD), is to serve as an independent entity ensuring the protection of the rights of individuals receiving services. Functioning as an advisory and evaluative entity, the HRC provides oversight to the administration of the Case Management Agency (CMA).

1.9. Human Rights Committee (HRC)

1.9.1. Contractor shall establish an HRC. The HRC is composed, to the extent possible, of two professional persons trained in the application of behavior development techniques and three representatives comprised of one or more of the following: persons receiving Long-Term Care services, parents, Guardians, or Legally Authorized Representatives of persons receiving or whom have received Long-Term Care services, or persons with lived experience having long-term care needs, or persons caring for a loved one with long-term care needs. An employee or board member of a Provider Agency within the Contractor’s designated service area shall not serve as a member of the HRC.

1.9.2. Contractor shall establish and facilitate a Human Rights Committee (HRC) pursuant to 10 C.C.R. 2505-10 Section 8.7202.Q et seq. Contractor shall maintain qualifications for each member of the HRC and make it available to the Department upon request.

1.9.3 Contractor shall submit a list of HRC members and documentation of qualifications of all new members annually.

1.9.4 Contractor shall notify the Department of any changes to the HRC members within 10 Business Days of the date of change.

1.9.5. Contractor shall establish at least one HRC as a third-party mechanism to safeguard the rights of persons enrolled in HCBS-CES, HCBS-CHRP, HCBS-SLS, HCBS-DD, State SLS, OBRA-SS, and FSSP. The HRC is an advisory and review body to the administration of Contractor.

1.9.6. Contractor shall develop policies and procedures which include, but are not limited to, HRC responsibilities for the committee's organization, use of Department required universal documents, the review process, mitigation of potential conflicts of interest, and provisions for recording dissenting opinions of committee members in the committee's recommendations.

1.9.7. Contractor shall orient members regarding the duties and responsibilities of the Human Rights Committee and make this information available to the Department upon request.

1.9.8. Contractor shall provide the HRC with the necessary staff support to facilitate its functions.

1.9.9. Contractor shall keep proper documentation and record of all HRC recommendations and ensure that all documentation is a part of the members record in the CCM.

1.9.10. Contractor shall maintain HRC meeting minutes, attendance logs, and supporting documentation related to an HRC meeting and make it available to the Department within 10 Business Days upon request.

1.9.11. Contractor shall notify the Department in writing of any changes to the HRC membership within 10 Business Days.

1.9.12. Contractor shall document all reviews within the CCM within 10 Business Days of the date of the HRC review.

1.9.13. Contractor shall be reimbursed for all HRC activities through a PMPM payment for all Members enrolled in HCBS-CES, HCBS-CHRP, HCBS-DD, and HCBS-SLS. Reimbursement will be based on Members that are active in the CCM with the Contractor and have an approved PAR in the Bridge.

1.9.14. Contractor shall invoice the Department for all State SLS, OBRA-SS, and FSSP Members reviewed by the Human Rights Committee using the template created by the Department.

Section 8.7202.Q

Human Rights Committees

  1. Each Case Management Agency shall establish at least one Human Rights Committee (HRC) as a third party mechanism to safeguard the rights of members in waivers targeted to individuals with Intellectual and Developmental Disabilities. The Human Rights Committee is an advisory and review body to the administration of each Case Management Agency.
  2. The Human Rights committee shall be constituted as required by Section 25.5-10-209(2)h, C.R.S.
  3. If a consultant to the Case Management Agency, regional center, or Provider Agency serves on the Human Rights Committee, procedures shall be developed related to potential conflicts of interest.
  4. The Case Management Agency shall orient members regarding the duties and responsibilities of the Human Rights Committee.
  5. The Case Management Agency shall provide the Human Rights Committee with the necessary staff support to facilitate its functions.
  6. Each Provider Agency shall make referrals as required in rules and regulations for review by the Human Rights Committee(s) in the manner required by Department.
  7. The recommendations of the Human Rights Committee shall become a part of the Case Management Agency’s record as well as a part of the individual's master record.
  8. The Human Rights Committee shall develop operating procedures which include, but are not limited to, Human Rights Committee responsibilities for the committee's organization, Department required universal documents, the review process, mitigation of potential conflicts of interest, and provisions for recording dissenting opinions of committee members in the committee's recommendations.
  9. The Human Rights Committee shall establish and implement operating and review procedures to determine that the practices of the Case Management Agency is in compliance with Section 25.510, C.R.S., are consistent with the mission, goals and policies of the Department, and Case Management Agency and ensure that:
    1. Informed Consent is obtained when required from the person receiving services, the Parent of a minor, or the Guardian or other Legally Authorized Representative as appropriate;
    2. Modifications of the rights of members occurs only within procedural safeguards as stipulated in Section 8.7001 and that continued modification of such rights is reviewed by the individual, their Guardian or other Legally Authorized Representative, and the rest of the Member Identified Team at a frequency decided by the team, but not less than every six months;
    3. Psychotropic medications and other prescribed medications used for the purpose of modifying the behavior of Members receiving services through the Intellectual and Developmental Disability waivers are used in accordance with the requirements of Section 8.7416, and are monitored by the Human Rights Committee on a regular basis; and,
    4. Allegations of mistreatment, abuse, neglect and exploitation are investigated, and the investigation report is reviewed.
  10. RESEARCH
    1. Any experimental research performed by or under the supervision of the Case Management Agency, the Community Centered Board, service agency or Regional Center shall be governed by policies/procedures which shall:
      1. Require adherence to ethical and design standards in the conduct of research;
      2. Require review by the Human Rights Committee; Address the adequacy of the research design;
      3. Address the qualifications of the individuals responsible for coordinating the project;
      4. Address the benefits of the research in general; Address the benefits and risks to the participants;
      5. Address the benefits to the agency;
      6. Address the possible disruptive effects of the project on agency operations;
      7. Require obtaining informed consent from participants, their guardians or the parents of a minor. Such consent may be given only after consultation with:
        1. The member selected team; and,
        2. A developmental disabilities professional not affiliated with the service agency from which the person receives services; and
      8. Require procedures for dealing with any potentially harmful effects that may occur in the course of the research activities.
