Ordinance 2026-01 - Data Centers
The County is considering an ordinance to define data centers in Chapter 23, Zoning, of the Weld County Code and specify where they are allowed.
The ordinance would allow data centers in Industrial zone districts with approval of a Site Plan Review or in the Agricultural zone district with approval of a Use by Special Review, as long as the property is not within a subdivision or historic townsite. County zoning only applies outside of incorporated cities and towns.
The Planning Commission reviewed Ordinance 2026-01(PDF, 75KB) at a public hearing on February 3, 2026 and recommended approval. The Board of County Commissioners approved the first of three readings of the ordinance at a public hearing on January 14, 2026 and second reading at a public hearing on February 9, 2026. Two pulbic meetings about the ordinance were also held on the evenings of March 23rd and March 24th(PDF, 337KB) .
Final reading of the ordinance is scheduled for the Board's April 6, 2026 meeting at 9:00 a.m. If you would like to provide written comments on the proposed ordinance to the Board of County Commissioners, please email them to askthecommissioners@weld.gov. Ordinance 2026-02 - Land Use Process
The County has adopted an ordinance to revise the procedures in the Weld County Code for certain types of land use applications, including Change of Zone, Use by Special Review, Site Plan Reviews, and divisions of land. The ordinance will not change the standards related to whether these cases are approved, but the steps taken to process the application are somewhat different. For example, rather than waiting until approval of an application to review the map that needs to be recorded, staff now informs the applicant or their representative of required map corrections earlier in the process.
