Request: Show Cause Hearing, PCSC26-0007, to determine whether or not the applicant is in compliance with certain Development Standards contained in Use by Special Review Permit, USR12‑0029, for a Mineral Resource Development Facility, including Open Pit Gravel Mining (sands, gravels and stones) and Materials Processing (Pawnee Aggregate Mine) in the A (Agricultural) Zone District
Legal Description: Part of the SE1/4 SW1/4 and S1/2 SE1/4 of Section 30; and part of the NW1/4 NE1/4 of Section 31 all in Township 10 North, Range 60 West of the 6th P.M., Weld County, Colorado
Development Standards:
1. Site Specific Development Plan and Use by Special Review Permit, USR12-0029, is for a Mineral Resource Development Facility including Open Pit Gravel Mining (sands, gravels and stones) and Minerals Processing (Pawnee Aggregate Mine), in the A (Agricultural) Zone District as indicated in the application materials on file and subject to the Development Standards stated hereon.
9. Fugitive dust and fugitive particular emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan at all times.
18. The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation, Mining, and Safety (DRMS).
21. The operation shall comply with all applicable rules and regulations of the state and federal Agencies and the Weld County Code.
24. Section 23-4-290.B of the Weld County Code limits the hours of operation for sand and gravel operations to the hours of daylight, except in the case of public or private emergency, or to make necessary repairs to equipment. Hours of operation may be extended with the specific permission from the Weld County Board of County Commissioners. This restriction shall not apply to operation of administrative and executive offices or repair and maintenance facilities located on the property.
36. The property owner or operator shall be responsible for complying with the Design Standards of Section 23-2-240 of the Weld County Code.
37. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250 of the Weld County Code.
38. The property owner or operator shall be responsible for complying with the open‑mining standards of Section 23-4-250 of the Weld County Code.
40. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services
42. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners.
