Pursuant to the Weld County Home Rule Charter, Ordinance Number 2026-06 published below, was introduced and, on motion duly made and seconded, approved upon first reading on March 2, 2026. A public hearing and second reading is scheduled to be held in the Chambers of the Board, located within the Weld County Administration Building, 1150 O Street, Greeley, Colorado 80631, on March 16, 2026. All persons in any manner interested in the reading of said Ordinance are requested to attend and may be heard.

Chapter 7
Adoption of Miscellaneous Standard Codes
Article I – Colorado Wildfire Resiliency Code
Sec. 7-1-10. Adoption of Colorado Wildfire Resiliency Code, Effective Date, and Applicability.
As required by C.R.S. Section 24-33.5-1237, the Board of County Commissioners hereby adopts the 2025 Colorado Wildfire Resiliency Code (the “Resiliency Code”) and subsequent versions thereto as may be adopted or amended by the Colorado Wildfire Resiliency Code Board (“Resiliency Code Board”), with the following modifications:
A. Delete all of Appendix C.
B. The Effective Date of the Resiliency Code for the purpose of enforcement shall be July 1, 2026.
C. The Resiliency Code shall apply to parcels located in Weld County outside the corporate limits of a city or town and outside the boundaries of a fire protection district, and which are shown on the State Map for the Application of the 2025 Colorado Wildfire Resiliency Code (or versions thereof subsequently adopted or amended by the Resiliency Code Board) and designated:
1. High Intensity Non-Federal; or
2. Moderate Intensity Non-Federal; or
3. Low Intensity Non-Federal.
4. Exempting therefrom any thirty-five (35) acre or larger parcel with only one (1) residential structure on it that does not abut a residential or commercial area.
Sec. 7-1-20. Enforcement of Colorado Wildfire Resiliency Code in Weld County.
Enforcement of the Resiliency Code to applicable parcels in Weld County shall be by the Colorado Division of Fire Prevention and Control pursuant to request of the Board of County Commissioners in accordance with C.R.S. Section 24-33.5-1237(2)(d).
Be it further ordained by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code.
Be it further ordained by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
