Commissioners approve updates to zoning code

The Weld County Board of County Commissioners adopted an ordinance, updating Chapter 23 of the Weld County Code to define electric vehicle (EV) charging stations and clarify where they are allowed as a use by right.
The ordinance adds a definition for “EV Charging Stations” to the zoning code and permits nonresidential EV charging stations in Agricultural, Commercial, and Industrial zone districts. The update does not affect the ability of residents or tenants to charge electric vehicles on property they own or lease in any zone district.
The board previously held a work session with staff on Nov. 18, 2025, to review the proposed changes and discuss compliance with House Bill 24-1173, which requires counties to address local permitting and standards for EV charging stations by Dec. 31, 2025.
House Bill 24-1173 allows counties to comply by adopting state model standards, developing local standards through an administrative review process, or formally stating their intent to continue using an existing permitting process. Weld County has chosen to continue utilizing its current permitting process, which only requires administrative permits such as electrical and building permits. A separate resolution will be presented to the board of county commissioners on Dec. 31, 2025, documenting that decision, and the county will notify the Colorado Energy Office by the March 1, 2026, deadline.
The ordinance was reviewed by the Weld County Planning Commission prior to adoption and completed the required three-reading process by the board.
The ordinance takes effect Dec. 29, 2025.
