Permits for Construction in Floodplains

Construction in FEMA-designated Special Flood Hazard Area (SFHA) must be consistent with County and Federal regulations.

A floodplain permit is required for any development within any SFHA.  This is both a federal and state rule found in the Code of Federal Regulations (44 CFR § 60.3) and the Colorado Revised Statutes (C.R.S. 29-20-104 and C.R.S 30-28-11).  You can also find more information in the Weld County Floodplain Management Ordinance.

Development:  Any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, or drilling operations or storage of equipment or materials. (44 CFR § 59.1)

Permits & Certificates 

Weld County has two types of floodplain permits: Floodplain Permit for minor work (FP) and Floodplain Development Permit (FHDP).

Flood Hazard Development Permit (FHDP)

Please visit the E-Permit Center to apply for the Floodplain Development Permit (FHDP)

  • All other development in the SFHA not listed not permittable with "FP"
  • Requires the stamp of a professional architect, surveyor or engineer
  • If in Zone A, requires a professional engineer to establish the base flood elevation (BFE)
  • If in a Floodway, requires a professional engineer to prove "no rise" (+/- 0.00 feet) and stamp a No-Rise Certification or submit a CLOMR to FEMA
  • A Letter of Map Amendment (LOMR) may be required

Floodplain Permit (FP) - for water heaters, furnaces, etc.

Please visit the E-Permit Center to apply for the Floodplain Permit (FP)

  • No fee required and may be signed by the property owner or an authorized agent (contractor)
  • Replace furnace, water heater or A/C unit
  • Remodel that is less than 50% of the value of the structure
  • Replacing a well pump for an agriculturally-exempt irrigation system
