Activities associated with construction and development increase the potential for stormwater pollutants to enter our waterways. The state of Colorado requires a stormwater discharge permit for construction activity disturbing more than one acre of land. For sites that are less than one acre, there are simple tips you can incorporate so that your project does not impact the water.

Becoming familiar with state regulations for construction sites will help you avoid costly enforcement fines and allow your project to be completed without delay.

State Requirements:

  • Obtain a CDPS Construction Stormwater Permit through CDPHE's Water Quality Control Division.
  • Develop a Stormwater Management Plan (SWMP) according to the permit requirements.
  • CDPHE requires a SWMP to be onsite at all times and available upon request. 

Local Requirements:

  • Obtain a Weld County Grading Permit through the Department of Planning Services.
  • Develop a Sediment and Erosion Control Plan, showing the location of all temporary control measures (or BMPs) to be implemented onsite.
  • Download the MS4 Pollution Prevention Plan Checklist and Manual. Complete and submit the checklist, listing all applicable temporary control measures to be implemented onsite.
  • Submit a set of as-built drawings after all drainage construction is complete.

MS4 Inspections:

  • Prior to starting construction, the site operator is required to contact Public Works to schedule a pre-construction inspection to confirm the installation of all initial control measures (bmps). 
  • During construction, routine inspections will occur at least every 45 days.
  • If violations are found, a compliance inspection will be conducted within 14 days. Compliance inspections are subject to a re-inspection fee.
